Terms of Service

These Terms of Service ("Terms") govern your use of the services provided by FreshSites ("we", "us", "our") through the website freshsites.com.au. By using our services or engaging with us, you agree to be bound by these Terms.
1. Service Description
FreshSites provides professional website design, development, hosting, and review collection services for local service businesses across Australia. Our services include:
- Custom website design and build
- Website hosting on Cloudflare infrastructure
- Automated Google review collection (on applicable plans)
- Website edits and content updates (subject to monthly limits — see Section 2)
- 24/7 customer support
- Ongoing website maintenance
2. Plans and Pricing
We offer the following plans. All monthly subscription plans include $0 setup fee and 24/7 support.

Prices are in Australian Dollars (AUD) and are inclusive of GST where applicable. We reserve the right to change pricing with 30 days' written notice to existing subscribers.
Website Edits
- Monthly subscription plans (Starter, Starter + Review Collector, Growth) — up to 5 edits per month included
- One-Time Website — up to 2 edits per month included
- An "edit" is defined as a single change request (e.g. updating text, swapping an image, adding a section). Requests involving multiple changes may count as more than one edit
- Unused edits do not roll over to the following month
- Additional edits beyond your monthly limit may be arranged at our discretion
3. Payment Terms
- Monthly subscription payments are processed securely via Stripe
- One-time payments may be made via Stripe or direct bank transfer
- Subscriptions are billed monthly on the anniversary of your sign-up date
- Payment is due at the start of each billing period
- If a payment fails, we will attempt to retry and notify you. Continued non-payment may result in suspension of your website
- For bank transfer payments, invoices are due within 7 days of issue unless otherwise agreed
4. Cancellation and Refunds
Monthly Subscription Plans (Starter, Starter + Review Collector, Review Collector, Growth)
You may cancel any monthly subscription at any time. Your website and services will remain active until the end of your current billing period. No refunds are provided for partial months. All monthly plans include a 30-day money-back guarantee — if you are not satisfied within 30 days of signing up, contact us for a full refund.
One-Time Website
The one-time website payment of $899 is non-refundable once the website has been built and delivered. The annual domain renewal fee of $40/year is non-refundable once the domain has been registered or renewed. If you no longer require hosting, your website files can be exported upon request.
5. Website Ownership and Content
- Your content — you retain full ownership of all text, images, logos, and other materials you provide to us. You grant us a licence to use this content solely for the purpose of building and hosting your website
- Website design — the website design, code, and templates created by FreshSites remain our intellectual property while your subscription is active. Upon cancellation, we can provide an export of your website content upon request
- Domain names — if you use your own domain name, you retain full ownership. We will assist with DNS configuration but do not claim any rights over your domain
- One-Time Website customers — if you have purchased a one-time website and do not pay the annual domain renewal fee ($40/year), FreshSites reserves the right to suspend or take down hosting until payment is received. The website will not be transferred or exported until all outstanding fees are settled
6. Acceptable Use
FreshSites reserves the right to refuse service, remove a website, or terminate an account at our sole discretion if the website or business is involved in any of the following:
- Illegal activity or promotion of illegal services
- Adult content, gambling, or firearms
- Hate speech, harassment, or discrimination
- Fraudulent or deceptive business practices
- Any activity that violates Australian law or the laws of the jurisdiction in which the business operates
No refund will be provided if your website is removed due to a breach of this section.
7. Third-Party Content Disclaimer
FreshSites may use publicly available information (including but not limited to Google Business Profile data, public reviews, and business directory listings) when creating demo websites or initial website drafts. We are not responsible for the accuracy, completeness, or currency of any publicly sourced content. It is the client's responsibility to review and verify all content on their website and notify us of any required corrections.
8. Right to Showcase
By using our services, you grant FreshSites permission to use your website as a portfolio piece, case study, or marketing example on our website, social media, and marketing materials. If you do not wish your website to be showcased, you may opt out by notifying us in writing at [email protected].
9. Communication Consent
By engaging with FreshSites — including responding to outreach, requesting a quote, or signing up for a plan — you consent to receiving communications from us via SMS, email, and phone regarding your service, website updates, and relevant offers. You may opt out of marketing communications at any time by replying STOP to any SMS or contacting us directly.
10. No Guarantee of Results
FreshSites provides website design and hosting services only. We do not guarantee any specific business outcomes, including but not limited to increased leads, phone calls, revenue, search engine rankings, or customer inquiries. A website is a tool — results depend on many factors outside our control, including your industry, location, competition, and how you market your business.
11. Demo Websites
We may create demo websites for prospective clients to showcase our capabilities. Please note:
- Demo sites are previews only and are not guaranteed to remain live
- Demo sites may use publicly available information from Google Business profiles
- Demos that do not convert to paid subscriptions will be removed within 30 days
- If you do not wish to have a demo site created for your business, contact us and we will remove it promptly
12. Your Obligations
By using our services, you agree to:
- Provide accurate and lawful content for your website
- Not use the website for any illegal, fraudulent, or harmful purpose
- Not upload malware, spam, or content that infringes on third-party rights
- Keep your account and payment information up to date
13. Service Availability
We strive to maintain high uptime for all hosted websites. However, we do not guarantee 100% availability. Downtime may occur due to maintenance, updates, or circumstances beyond our control. We will notify you in advance of any planned maintenance where possible.
14. Limitation of Liability
To the maximum extent permitted by law:
- FreshSites is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services
- Our total liability for any claim arising from these Terms is limited to the total amount you have paid us in the 3 months preceding the claim
- We are not responsible for any loss of business, revenue, or data resulting from website downtime, errors, or service interruptions
15. Indemnification
You agree to indemnify and hold FreshSites harmless from any claims, damages, or expenses arising from your use of our services, your content, or any breach of these Terms.
16. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer rights under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). Our services come with guarantees that cannot be excluded under Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
17. Governing Law
These Terms are governed by the laws of Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Western Australia.
18. Amendments
We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our services after changes take effect constitutes acceptance of the revised Terms. For material changes, we will provide 30 days' notice via email.
